SSI and Social Security Disability: How They are Different (Virginia Lawyer's Perspective) Sunday, August 29, 2010

Social Security Disability (sometimes called SSDI) and SSI are confused by many people. I have been a Virginia Disability Lawyer for over 30 years. None of my clients know the difference between the programs. These are the most important differences between these programs:

First, in order to obtain Social Security Disability, you must have an earnings record and show you are disabled. Housewives come to me and say "Why cannot I get disability?" I reply, "Where is your earnings record?" Self-employed people call me and say, "Where is my disability?" I respond, "Did you ever file taxes and pay into Social Security?" People who are paid in cash or under the table contact me and request Social Security. I say, "You only get out what you paid in, it is not a free ride."

Second, for SSI, you do not need an earnings record. You only have to show you are disabled. But SSI is a welfare program and even though its full name is Supplemental Security Income it probably should have been called "Welfare Disability." As a welfare program, there is a means test. This means even if you are disabled you cannot receive SSI if you have either assets or income. In 2006, you cannot have more than $2,000.00 in cash assets and expect to qualify for SSI. The same housewife who could not obtain Social Security may also not be able to obtain SSI because (1) she has other unearned income; (2) her husband has too much income; and (3) she or her husband has too many assets.

Third, the Social Security benefit is dependent on the earnings the worker paid in and could be as high as $2,053.00 per month. Many ask me, "Why isn't my benefit higher?" My answer always is, "You get out what you paid in." Working at a minimum wage job is not going to result in a very high benefit. Not working for a number of years is also going to result in a lower benefit. On the other hand, the maximum SSI amount an individual can receive in 2006 is $603.00 per month but this does not depend on earnings.

Fourth, an individual on Social Security Disability can also expect a payment to dependent children up to age 18 or until the child graduates from high school. The dependent children share equally about 50% of the parent's benefit. On the other hand there is no dependent care benefit for a recipient of SSI. People on SSI will often call me and say "Where is my child's check?" Regretfully, I have to tell them SSI has no child benefit.

Fifth, Social Security Disability & SSI are similar in one way. The disability test is the same.

Sixth, when you file for Disability, Social Security will first check if you are eligible for Social Security Disability before allowing you to apply for SSI. Generally, if your Social Security check is higher than $603.00, you would not be eligible for SSI. On the other hand if your Social Security check is lower than $603.00, you may be able to receive a small SSI check so your total benefit is about $603.00 per month.

In Summary, when a person says I am on "disability" or I want "disability", there is a big difference between SSI and Social Security Disability. Remember SSI is a welfare benefit & Social Security Disability is an earned benefit.

This is part of the Monster Stomp show at Busch Gardens Europe. Filmed during the last show of the season. Drummers talent is outstanding. He is fast, very fast, and in my opinion, he could put on a show by himself. Busch Gardens would be crazy to not bring him and the rest of the show back next year. Standing room only. We waited in line for 2 hours for this show, that's how good it is. I just hope BGE is paying him and the rest right. Their talent deserves some cash. The individuals who perform at the Monster Stomp obviously spent a lifetime training. They could easily be in Broadway.

Portsmouth is one of the older cities in the Tidewater Region of Virginia, where the James, Rappahannock and Elizabeth Rivers enter Hampton Roads. Here are some of the benefits that are gained through CLEP.

1. Reduce college expenses. Getting a college degree is becoming more expensive every year, with a single credit hour costing over $1000 at some universities. A CLEP test can help fulfill up to 12 credit hours. This means that one CLEP, costing under $100, can save hundreds or thousands of dollars in tuition alone. With the current economic shake up on Wall Street an appropriate place to start is with Jamie Dimon, President of JP Morgan Chase. Security Deposit Itemization Form

Almost every landlord requires a tenant to pay a security deposit when they rent a residence to them. Security deposits help ensure that the tenant doesn't damage the property, but is also often used as the last month's rent if the tenant gets behind on the rent (although in some areas this practice isn't legal). One legal form that is priceless when it comes to managing security deposits is the "Security Deposit Itemization Form."

This form is brought into use when a tenant moves from the residence, thus terminating their lease. At this time, the landlord has approximately 30 days to return the entire or partial security deposit back to the tenant. The best way to return a tenant's security deposit is to mail them a check along with the Security Deposit Itemization Form in an envelope through the mail. When part or all of the security deposit has been kept by the landlord because of property neglect and/or damages, the itemization form proves a vital piece of evidence showing in black and white exactly why the landlord kept all or a portion of the security deposit. Below are the specifications that are usually included on the above mentioned form.

1.) Important Dates and Info - Usually, the date that the form is being filled out, the date that the tenant moved into the property, the address of the property, and the forward address of the tenant that paid the deposit are all included at the beginning of the form.

2.) The Security Deposit Amount - The amount of the initial security deposit that was paid by the tenant at move-in.

3.) Itemized Damages and/or Repairs and Replacements - This is a detailed list of what the landlord is deducting from the tenant's security deposit. Here, a brief description and the exact amount of each deduction should be listed.

4.) Total Amount Deducted - This area is usually near the end of the form and is the total amount that the landlord owes back to the tenant after any deductions made in step three above. Included in this section is usually a small line to record the check number of the check that the landlord sends the tenant (for recording purposes).

5.) Comments - It is likely that the tenant will get upset if they do not receive their entire deposit back. The comments section is a good place to let the tenant know directly from the landlord why the deductions where made, and what proof he/she has indicating that the tenant was directly responsible.

Before the landlord fills out and mails the above form with the tenant's check (if there is one), make a copy of both the form and check for one's records. Nothing stands up in small-claims court like a professionally constructed paper trail.
